Terms of Service

Welcome to Adagioz & Harmonie. These Terms of Service (“Terms”) govern your access to and use of the online store and related services (the “Services”) operated by Adagioz & Harmonie. The terms “we”, “us” and “our” refer to Adagioz & Harmonie. By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

  • Submitting an order constitutes an offer to purchase. Orders are subject to acceptance and availability. We will confirm acceptance of your order by email.

  • Payment must be authorized and received before an order is accepted. Review your order carefully before submitting; cancellations may not be possible after acceptance. If an order is canceled or changed by us, notification will be sent using the contact information provided.

  • Prices, discounts and promotions are subject to change without notice. Prices shown at the time of purchase are the prices charged, unless an obvious error is made.

  • Unless stated otherwise, prices do not include taxes, duties, shipping, handling, or import fees, which are the customer’s responsibility.

  • Shipping times are estimates only and may be affected by carriers, customs, or events beyond our control. Title and risk of loss pass to you when goods are transferred to the shipping carrier.

  1. Relationship with Shopify

  • The Services are powered by Shopify. Shopify does not control the Services and is not responsible for any aspect of sales between you and Adagioz & Harmonie. By using the Services you release Shopify from claims related to your purchases from Adagioz & Harmonie.

  1. Privacy

  • Personal information collected through the Services is governed by our Privacy Policy. Because we operate on Shopify’s platform, Shopify will process certain data in accordance with its privacy practices. See our Privacy Policy for details.

  1. User Content

  • Any comments, reviews, suggestions, or other material you submit (collectively, “User Content”) may be used by us worldwide, royalty‑free, sublicensable and transferable for any purpose. You represent you have rights in the content you submit and that it does not violate any third‑party rights. We may remove or refuse any User Content at our discretion.

  1. Errors and Omissions

  • While efforts are made to ensure accuracy, the Services may contain typographical errors, inaccuracies or omissions. We reserve the right to correct such errors and to cancel or modify orders where necessary.

  1. Prohibited Uses

  • Use of the Services is permitted only for lawful purposes. Prohibited actions include, without limitation: infringing intellectual property, posting illegal or abusive content, using automated tools to scrape or access the Services, transmitting malware, or interfering with our security measures. Violation may result in suspension or termination of access.

  • TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER ADAGIOZ & HARMONIE NOR ITS AFFILIATES, OR SHOPIFY, WILL BE LIABLE FOR INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF PROFITS OR DATA, ARISING OUT OF YOUR USE OF THE SERVICES OR PRODUCTS.

  1. Indemnification

  • You agree to indemnify and hold harmless Adagioz & Harmonie, Shopify and their respective officers, directors, employees and agents from claims, liabilities, losses and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms, violation of law, or infringement of third‑party rights.

  1. Severability

  • If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in force to the fullest extent permitted by law.

  1. Waiver; Entire Agreement

  • Failure to enforce any provision of these Terms does not waive that provision. These Terms, together with our policies and any other legal notices published on the Services, constitute the entire agreement between you and Adagioz & Harmonie.

  1. Assignment

  • You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations without consent.

  1. Governing Law and Jurisdiction

  • These Terms are governed by the laws of the state or jurisdiction where Adagioz & Harmonie is established. Any disputes will be subject to the exclusive jurisdiction of the courts in that jurisdiction. (Please specify your business jurisdiction so this clause can be completed.)

  • Headings are for convenience only and do not affect interpretation.

  1. Changes to the Terms

  • We may update these Terms from time to time. Material changes will be notified as required by law. Continued use of the Services after changes constitutes acceptance of the updated Terms.
